Legalization of prostitution refers to making prostitution a special service industry recognized by society through legal permission. There are three reasons for supporters: firstly, legalizing prostitution can solve the necessary physiological needs of men and help reduce sexual crimes; Secondly, prostitution is something you love and I wish for, and there is no need to escalate to an illegal level; Thirdly, some foreign countries allow the legalization of sexual transactions, which is in line with the trend. This reason may seem reasonable, but it really cannot withstand careful consideration.
From the most basic perspective of human nature, there are weaknesses, greed, and licentiousness in human nature, but this does not mean that people will indulge. Human sexual rights are equal, not only to legalize prostitution in order to meet male sexual needs, but also to infringe on the sexual autonomy of another group of people in order to meet male sexual needs. And indulging in casual and rampant sexual demands will inevitably cause a devastating blow to the basic cells of society, marriage and family. In fact, in a sense, the important role of law is to regulate, correct, and suppress the weaknesses of human nature. In other words, if we can allow prostitution today to meet people's sexual needs, can we agree to drug use and other behaviors tomorrow to satisfy some people's pleasure? The answer, of course, is no.
From the perspective of the rights of freedom and equality, human society always pursues freedom and equality, but freedom does not mean doing whatever one desires. Prostitution is the exchange of money for sexual services. Sexual service providers cannot have so-called freedom, and the status of both parties in transactions cannot be equal. The fact that you love me during prostitution is only superficial, while sexual exploitation and even oppression are the essence. The so-called sexual freedom is just a false freedom that treats women as commodities, but in fact, it is a naked and true exploitation of women. History and reality at all times and in all countries have long proven that prostitution is an extreme way of objectifying women. The so-called 'you love me and I wish', but some people take it for granted. According to the 2017 report of the United Nations' Population Sales Task Force, over 80% of the 13000 women surveyed were forced to engage in sexual services against their will. This is the true social reality.
Even more vigilant is that sex trading has always been a source or hidden danger of various illegal crimes. Even in countries where sexual transactions are legalized or widespread, female sex workers have the highest risk among all professions, with a probability of being injured or even killed dozens of times higher than the second most dangerous profession. The judicial practice in China also shows that there are often other illegal and criminal activities hidden behind prostitution and prostitution. Taking organizing prostitution as an example, some underprivileged women are often deceived by false recruitment, pyramid schemes, and other means at the beginning, and then forced to engage in prostitution activities through naked photography and other means. Once prostitution is legalized, various crimes such as forced prostitution, organized prostitution, and luring young girls into prostitution stipulated in China's criminal law will be eliminated. These serious illegal crimes that violate women's legitimate rights and interests will not be punished, thus shaking the current criminal governance system of the criminal law.
